We are considering changing the way we give employees sick time to use. Through the current system, employees get 5 sick days to be used during the course of the year and these days are advanced to them on January 1st each year. We are interested in exploring an"accrue-as-you- go" type of system where they would earn 1/2 day per month to use only after it has been earned. I would appreciate any experiences with using this method of granting sick time anyone could share. We are attempting to minimize the impact that unexpected call outs due to illness have on productivity and morale. Additionally, I recently heard of a sick time "cash-in " program that some companies implement. With this type of program, the company will allow employees to cash in up to 3 sick days per year to help reduce the cost of benefits to be paid throughout the election year. Does anyone know if this in any way would jeopardize the Section 125 status of the benefit plan the employee is subsidizing with the sick time cash in? Again, any insight would be much appreciated. The most successful plan I ever worked under was a system of personal days. We received 5 "sick" days, 10 "vacation" days and 1 floating holiday that accounted for 16 personal days. You accrued these monthly (1.33 days per month)and could use them as you accrued them. Employees really loved it and it was easy to track. It also reduced the number of sick days used because people were more inclined to schedule time off. At the end of their anniversary year, the employee could roll over up to two weeks or they would be paid half time for any days turned in.

Sick leave programs are historically a public sector benefit. To review successful policies (CBA language)I recomend you submit a "Public Records Request" to The City of: Coral Springs, Coconut Creek, Deerfield Beech and Hollywood, FL. This should help with accruals and payouts. Contact information can be obtained through their respective web pages.

We currently allow employees a total of 6 sick days (we are not able to offer STD) that accrue - 2 HOURS per pay period - 24 pay periods. Sick time rolls over at YE with no cap on total accumulation but is not paid out upon departure from company.

I think accrual works well, but we still have some emp'ees who use it as fast as they get it! If they do not have enough sick leave accrued and are out, the time is docked against vacation.

A current accrual method is very common, esp. as one other respondent noted in a combined PTO program. I work w/alot of companies looking to redesign their paid leave, and there are different ways to do it. You didn't mention if people can carryover the unused days under the current plan, but under 125 you can't have the option to cash out or carry over. You could make the cash out mandatory.

We are considering a PTO program, combining sick, vacation, and personal time. My question is, because we are in CA, would our PTO program be an accrued benefit requiring us to pay the accrued unused balance at termination? I believe the answer is yes because that is how we must treat vacation. Combining vacation with other time off would mean other time off would need to be treated like vacation.

You are correct. PTO is treated like vacation, and in CA it would be a vested benefit.
