Our current policy is that employees must exhaust all accrued general leave (we combine sick and vacation) before they can receive STD payments. This creates a problem for those employees who have enough leave accrued to get them through a medical leave of absence and subsequently do not receive STD payments. They feel they are being penalized for saving their leave (even though their leave pays them 100% vs. 60% for disablity). Any comments/suggenstions?

Our STD policy goes into effect on the 8th calendar day whether they still have leave time available or not.

STD begins for employees on the 8th consecutive calendar day that they are out. Our employees do not have a set number of sick time but occurrences. STD benefits are then on a service schedule so that if an employee is employed from 6months to 2 years, they receive 26 weeks at 50% pay; 2-5 years they receive 6 weeks at 100% and 20 weeks at 50%; 5-15 years they receive 13 weeks at 100% and 13 weeks at 50%; 15+years they receive 26 weeks at 100% pay. STD is effective after 6 months of service. The disability benefits are reduced by any statutory state benefits paid.

At what point does someone qualify for disability? From as many plans as I've looked at it is unusual to exhaust discretionary leave before eligibility for STD, but using sick leave as a supplement to disability is not unusual.
