I have never dealth with FMLA before and have a couple of questions if anyone can help me.
1. Does the employee HAVE to request the leave or can the employer suggest it? (We are a manufacturing company and have a factory worker who qualifies for intermittment leave. She doesn't know about FMLA so we want to recommend it to her so her missed time from work doesn't count against her). 2. Is there a certain form or method to use in keeping track of time taken and time remaining? Any help will greatly be appreciated!!!! |

It is the employer's responsibility to inform the employee that leave time is going to be counted against FMLA, not the other way around. Any qualifying absence whether it is non-occupational or worker's compensation should be counted as FMLA. The time should be coded as FMLA in you tracking system - for employers that are not collecting attendance records in a data base you'll need to have someone do it manually. If you want to do a little research you can find alot about FMLA on the internet. |
