We conducted Open Enrollment in November. We just got word that a major physician's association in our area has terminated its contract with one of our two HMOs. This affects a significant number of our employees. Does Section 125 prohibit a special open enrollment for those employees affected by this type of mass migration?

The samething happened tous with Tufts in N.H., and we are having a special enrollment for those employees that are being affected. There options are to remain on Tufts but select a Massachuetts provider being that our company is in Mass.,or they have a choice of two plans that are being offered to select from.The way things are going with the HMO's we have to work with our employees and make sure that everyone is covered.
