Question about your use of Sick Time

Two questions for those who differentiate between sick and vacation time:
1. does your vacation time off policy allow someone who gets sick on a day they've requested off for vacation to charge that

Two questions for those who differentiate between sick and vacation time:
1. does your vacation time off policy allow someone who gets sick on a day they've requested off for vacation to charge that time to sick time off?
2. do you allow folks to use sick time for doctor's appointments for self and family members, and for care of family members?

1. Yes, as long as they bring in a doctor's note.
2. We "give" employees 10 sick/personal days. This means that we'll pay up to 10 days off for reasons of illnesses (employee's) or for other reasons (sick family member or emergencies such as basement floodings, doctor appointments, to bring child to school on their first day of school, etc.)
I hope this helps.
P.S. Also, keep in mind that FMLA requires employers with 50 or more employees to give them up to 12 weeks of unpaid, job-protected leave for their own or for a family member's serious medical condition. The terms "leave", "family member", and "serious condition" are defined on the Act. If you need more info on this, let me know. It can be very confusing.

We do not allow ees to substitute sick leave during a vacation leave. I would consider that the same as getting sick on their scheduled day off.
Our policy allows ees to use sick time for care of immediate family members or other relatives who reside in their household. I don't know if your company must be FMLA compliant, but that could be a factor here as well.

1. No, we would not, unless the circumstances were dire (i.e., an accident) and a medical excuse was provided.
2. Yes, we do. Some states (such as California) require the employer to allow the employee to use sick benefits for the care of sick children.

thanks for all your responses.
my remaining question has to do with time off for doctor's appointments for self and family.
we offer 10 sick days and 4 personal days. Logic tells me to say personal days only for appointments, but I frankly don't want to be in the position of discussing a sick baby taken to the doctor's, and whether that's sick time or personal time. So I'm inclined to allow it.
I know someone is going to say combine them into a Paid Time Off account, but until we do.....

The FMLA issue can be a big one here. You might want to consider defining your policies and/or combining your personal time with Sick time. If you combine it all and have a PTO with vacation, you might be required to pay out the balance of the PTO time when someone terminates.

I guess my company is quite a bit more lenient than others when it comes to sick time. Employees are able to take sick time in increments of half days, whether that be "I'm not feeling well, I need to go home" or "I have a sick child I have to pick up from school" or "I have a doctor's appointment." Although I've never had the request to switch a vacation day to a sick day, I must say I'd not be inclined to do so either. And in regards to FMLA, if you have 50 or more ees, you must have exhausted you sick, vacation and personl time before FMLA leave counts. (And don't forget - not that this is a discussion for FMLA - that if the employee is qualified to take FMLA leave, they may do so in increments of less than one day.) Hope that helps some.

This may be your company's policy, but I don't believe FMLA dictates this. We don't even require an employee use their vacation time, but I think FMLA actually leaves it up to the employer to determine all of it.

Can anyone tell me if you are required to pay a terminated employee for unused/accrued sick pay? Is it paid out like vacation pay?

My understanding is that if sick time is separated from vacation time, then it is up to the employer whether or not to pay it out (sick time) upon termination. If paid time off (PTO) is all lumped together, then it should be paid out upon termination.
