If an employee has used up his/her alloted paid sick time in a given year, and finds that s/he must call in sick again with-in that year, can an employer leagally deduct that time from the employee's

If an employee has used up his/her alloted paid sick time in a given year, and finds that s/he must call in sick again with-in that year, can an employer leagally deduct that time from the employee's vacation allotment? (with or without employee consent?)

This will only be acceptable if your respective policies allow for the accrued time to be interchangeable, or that vac can be paid unilaterally. Otherwise, the non-exempt employee has an unpaid day off. |

Internal policy can dictate for the non-exempt employee. Our company's personnel policy states that a non-exempt employee, if she or he works less than the normal work week, the hours must be deducted from paid time off. We as the employer determine what type of paid time off will be utilized - whatever paid time off is available. Of course, consult legal counsel before making any changes in your company policy. |
