Has anyone else dealt with this scenario? An employee took off 5 days vacation. While on his 3rd day off on vacation his step-father passed away and had to come back from his "vacation" to deal with the death in the family. We offer 3 days funeral leave for immediate family (step parents included). This employee now is demanding we change 2 of his days "vacation time" with "funeral leave" instead. This employee also said it should work the same way if you get sick while on vacation, changing the time to sick leave. We don't have anything in our handbook addresses substitution of time. Has anyone else had to deal with this?

I do agree with the employee on only using 3 of his vacation days and then using his funeral leave for time but I don't think it is the same for sickness unless it is serious enough to land the person in the hospital. There is too much room for abuse.

Having said that our company does not distinguish between vacation, sick and/or personal days. Everyone has a certain amount of paid time off to use as they choose in addition to bereavement leave.

In terms of sickleave. We make provision for the change of vacation leave to sick leave, only and only when a medical certificate is handed in. In terms of the funeral - I agree that it would only be fair to change the days to family responsibility leave, it was beyond his control and traumatic.

We had a similar scenario. One of our employees was on a weeks vacation, his mother passed away and the services were going to be Thursday and Friday of that week. We have 3 days paid bereavment, since it was his mother, we changed 3 days of vacation to bereavment and credited those 3 days back to his available vacation. No way would we pay all 5 days as bereavment. It would be a deviation of policy, and you would have to offer that to everyone.

Our agency has a policy that we will not change vacation leave to sick leave unless they have a doctor's slip. We will change vacation leave to administrative leave "in cases of death or disaster in the immediate family".

There are things that you have not defined. Are you working with a union contract?

How long has this individual worked with you, and has this been an issue before?

Given a no on the first two questions, please do not ever inhibit a grievor from days off without taking vacation if your company has this provision.

Trust me, I've been there, even as a management individual. Death in the family is not an easy go, provide the support that you can and call it a day.
