ERISA coverage for group term life insurance

I have an employee on LT disability. My corporate counsel says that I have to continue all benefits under ERISA rules. Does anyone know how long I have to retain his life insurance? The employee is 62

ERISA coverage for group term life insurance

I have an employee on LT disability. My corporate counsel says that I have to continue all benefits under ERISA rules. Does anyone know how long I have to retain his life insurance? The employee is 62 and probably will stay on disability until he retires. Do I need to continue his insurance until then or is there a specific time frame? (like COBRA--18 months)

ERISA does not specify what happens, your group policy and HR practices do. Many Group Term life insurance plans have a waiver of premium clause that comes into play when someone is permanently disabled.

In addition your personnel handbook may also state what happens to an employees benefits when they are disabled.

For example, when do you terminate a totally and permanently disabled person? What do you do with their medical coverage at that point.

One thing to keep in mind, benefits entitlement does entitle someone to remain employed.
