Do you offer investment advice to your employees, and if so, how is it handled? We currently only provide annual employee retirement education to our workforce through our 401(k) administrator but employees always ask for specific investment advice. Thanks.

Due to fiduciary responsibility issues we do not provide investment advice.

Your 401k administrator should be able to explain to participants what various fund categories mean, such as small-cap and aggressive-growth; how to interpret the information presented in a prospectus; and also some rules of thumb in terms of how one should distribute one's investments among aggressive (i.e., more volatile) and more "stable" (i.e., less risky but less growth potential) funds based on one's planned retirement age.

All investment education is done through our recordkeeper and financial agent/broker. I stay totally out of the personal side since I am a fiduciary. But I do review the investments from the professional fiduciary side.

The PPA of 2006 permits providers to provide investment advice and recommend their own funds without violating the fiduciary rules.

The Plan fiduciaries are only responsible for making prudent choices of the advisors and the plan options which is not a very high hurdle.
