Domestic Partner - hoe to reflect premiums in Payroll

Hello,

Our employees have to pay 20% of their insurance premiums.

When someone adds a domestic partner, i know that the employee keeps paying Pre-Tax premiums for himself and Post-Tax premiums for his partner.

But there's also some additional income added. How do i reflect it in payroll?

Could anyone advise me how to reflect the addition of the Domestic Partner in Payroll?

Also, does the company end up paying some amount for the domestic partner.

Any advise would be greatly appreciated as i never had situations where i had to add domestic partners.

The portion of the employer's cost that is spent on the domestic partner must be recognized by the employee as income.

This can be done by either providing the employee with a 1099 at the end of the year or by adding the value to the taxable wages each pay period.

I had that same question. Also, regarding domestic partners and insurance: Does any one knwo if there are state laws regarding this? If so, does the Federal Defensive Marriage Act out rule state laws? Thanks

Yes there are state laws that apply to the eligibility of domestic partners to coverage. there are also likely state laws on the deductibility or taxability of that coverage as it applies to that specific state's business and income taxes.

However the federal laws with regard to the taxability and non deductability of the value of these benefits is not affected by state law.

Just out of curiosity, how do state law and federal law come into play in states where same sex marriage is legal - CA and MA most notably.
