We have a union employee who had surgery on his left little finger and has been on restricted duty for more than four weeks. We have tried to accomodate "right hand only" work. We now have a six week extension of the modified work activity and truly do not have anything he can do (he is a stockhandler in the warehouse.) He places his left hand behind his back and refuses to use his left hand while driving a hi-lo (he would need to flip on the turn signal with his left hand, otherwise he could steer with his right hand.) Do we have any recourse?

What if any are the provisions in the CBA for an injured worker? Was this a work-related injury?
What state are you in?
Most employers/insurance companies hold the belief that for a WC injury it is better to have the injured employee do ANYTHING rather than have them out of work and being paid partial wages.
If it is not WC, you need to look at how you have or have not accommodated other non-work-related injuries. Many employers have policies that "light duty" is not available for non-work related injuries.
But in a union environment, it always comes back to the CBA.
