We are in NY and I have an employee that was 20hours and now is moving between 20-28 hours. Is there a law of compensated vacation that I need to follow?

Ther is usually no state law or federal laws regarding company vacation entitlements. The rules should be spelled out in your policy manual. If there is no policy manual try to learn what past practice in your firm has been.
