Hi,

Could anyone tell me where I could find information on how many (average) employers in the US pay overtime based on a 40 hour workweek vs an 8 hour workday? I'm looking for an average of all states, not per state rules.

Not sure what the question is. Any employer in California would have to pay OT in excess of 8 hours per day 'cuz that's the law. All others, so far as I know, are in excess of 40. Why any employer in a 40 hour/work week would pay OT for over 8 hours worked in a day is beyond me, so I'd have to say that 100% of employers in a state requiring OT pay for hours over 40 in a work week pay it that way.

But I'm reasonably certain that's not what you're looking for

Some CA-based companies do so for employees outside CA as well. Also, some CBAs specific it as well. My son is a member of the Communications Workers Union and their CBA with ATT requires it even though he's in TX.

Since it's on a company by company basis it would be tough to get the data you're looking for Stephanie.

My previous employer paid OT on a daily basis. This was a non-union organization. I agree with Ida -- you'll find that its going to be tough to come up with actual numbers.

Colorado requires daily overtime after 12 hours. Alaska after 8 hours, Nevada after 8, Puerto Rico after 8 and on holidays, and the US Virgin Islands after 8.
