Agree with mroberts - but put it in writing this time and they sign which option will be used!

I think you need to let year 1 stand. He took the comp. and did not sign up for benefits. So, for 1 year the company saved premiums. Now you are in year 2 and you have nothing in writing. You can't stop him from signing up. But future bonuses are discretionary.
