I found myself confused as to what type of COBRA notice to send to EE who voluntarily resign?

Our TPA sends out the same packet as those covered under ARRA because it requires the former employee to answer the eligibility questions and elections. This employee would have to answer "no" to the involuntary question. Then I get a copy as the employer to verify.
Not sure exactly what happens if we don't agree...haven't had that happen yet. If I were doing it myself, I would send the same election form but with a cover letter stating that since they voluntarily terminated that the ARRA election is not applicable and that the COBRA subsidy would not apply (in big bold print) |
