I have taken on a new position in my company and am responsible for reconciling hours worked, available leave, etc for our employees. My question is-if our exempt employees generally work 80-85 hours in a 2 week pay period- but during one pay period leave early one day and only work 78 hours- do I deduct 2 hours from their leave balance to make up those hours? Also if they take a whole day but still work 75 hours- do I dock a full day? I'm confused because our hourly staff can "make-up" their time- so if they work 75 hours I only dock for 5. Also we have PDOs so our sick and vacation are all lumped together.

We handle PTO for exempt employees in 1/2 and full day increments. So we have flexiblity in allowing them to leave early or come in late when needed for an appointment etc. If they abuse it, we address it with them.

What does your company's policy say? And what has the company actually done in the past. What you suggest is legal, but you also need to find out if that's how your company handles it.

Agree -- it is usually company policy on how they require PTO to be used when a "full week" isn't worked. Generally at our company if an exempt misses more than 2 hours, their PTO bank is docked. Less than 2 is pretty much just unnoticed unless it happens a lot.

But it is legal to dock a full day for a partially missed day or in a week where more than 40 hours are worked.
