We are a non-profit in MS. We, along with the public schools in our area, have great difficulty recruiting bus drivers. The public schools have been providing benefits for their drivers even though they are part-time. Our agency policy is to not provide benefits for PT employees (we only have about 3 other than bus drivers). If we decide to provide benefits for the PT drivers, but not the others, will we be violating any laws? (I could not find any such laws.) The other PT positions are for programs with budgets that could not bear the additional expense.

You need to check with your insurance broker/carrier. Sometimes you can class out specific groups, but I am not sure of MS insurance law or whether they can use a classification other than hours. It might be possible, but even if the law allows it, the carrier might not.

You would not de violating any laws by classing them out. How many hours per week would they be working? Most insurance carriers will not allow them on the contract unless they're working at least 20 hours per week. If you're a large enough group, it's possible you could have a little bit more flexibility.

They work 20 hours per week. I don't think our carrier has them classed out, but I am checking on that.
Our organization employes about 160 people -about 150 are full time.

With a group that size, you will have no problem getting these PT employees insured under the contract.
Have you thought about going self-funded? This will probably help down the road since you're competing against public schools for talent and they are almost certainly self-funded.
