We have several facilities around the country and plan to open in more states soon. In the past, we have had a team go to the various locations for between 2-10 months, though it will probably be 3-6 from now on. Each time they have moved, they have had taxes taken out for the various states. However, it has now occurred to me that though this makes the cost centers work out, it is really doing a disservice to the employee if they should ever be terminated or laid off, since they will not have much in the way of base wages accumulated in each state. It would no doubt be better to have worked for 12 months in CA rather than 3 months each in 4 states. This has recently come up now that this team is resigning, 1 for medical reasons and the other to be the caregiver. They won¡¦t be eligible for UI, but one may be for SDI, but claims this will be handled by the UK working with the US..


Can anyone tell me how long an employee may work in a state without paying taxes in it?

I would like to have them based out of CA (or their home state if we hire out of state employees to replace this team) and just have them work temporary assignments elsewhere. (Not really because of the OT and labor laws, but I don¡¦t want to appear heartless ƒº and I¡¦m used to the laws here. Besides it¡¦s the cost of doing business). It would certainly be beneficial for them with the CA OT and given the fact that it is the only facility that will even approach 50 employees in terms of FMLA, though taxes may be more out here as well. How do other companies handle this? Any guidance would be appreciated. Thanks.
