We pay BW and have pay date 1-Jan of 2010. I want to understand what other companies are doing (earlier vs. later) and any compliance issues you have seen. I am told that as long as we are consistent

Sounds like this discussion has morphed into 2 separate issues.

First issue: in my experience holidays that fall on a non-working Saturday are usually granted on Friday before; and holidays that fall on a non-working Sunday are usually granted on Monday after.

Second issue: 27 biweekly pay periods show up every 11 years. Watch out for those frisky Finance folks who will try to adjust the 27th pay period downward to cover for their lack of planning for the 27th pay period. You risk antagonizing the workforce and inviting a union in to protect your workers' interests.

There are no federal laws (beyond exempt employees under FLSA) that require holidays be given or paid at all regardless of the day on which they fall. Even if a company would normally pay a holiday that happens to fall on a workday, there is no requirement that they do so if that holiday falls on a non-workday.

Especially in this economy, I have seen many companies that don't pay or give a different day for a holiday that falls on a non-workday.
