We have employees who drive a company vehicle to their first job site. The drive from home to the worksite and back home from the last job site is considered commute time as long as it is within the normal commute area. Can anyone tell me what would be considered the “normal commute area†or distance? Does it change geographically (within a metropolitan area) and is it a distance or a unit of time?

We are in CA as well as several other states.

To me, a "Normal commute time" would be individually based. That is, how long does it take Employee A to go from home to the office/main location. Or were they hired knowing that they would have to drive within x miles radius of their home or the office? You could define a standed normal commute time based on your knowledge of historical job sites and their distance from your office/employee homes.

From there, I am assuming that the job site locations change frequently. If the distance from home to the work location is greater than a specified amount more (say 20%), then, for our company, that would be outside normal commute time.

Employees individually make the choice on where to live. In the past, I have employees who have lived as close as a mile and as far as 60 miles from our office. Since it is their decision to do so, I don't feel it is the employer's responsibilitity to pay for their individual regular commute time.
