Hello,
In communicating to staff their 2010 salary increases, employees will receive a total rewards statement.

My employees share their compensation with others staff causing morale issues. To avoid this, I would like to add a disciplinary disclaimer on the statement.

Can I enforce the discplinary action? If not, what else should be done to ensure staff do not share their compensation with others?

Unfortunately under the NLRA, you cannot forbid employees from discussing their own compensation with other employees. That falls under a protected right. You can discipline them for discussing the compensation of others (so your payroll/HR people can be required to hold salary information confidential).

If there are differences in pay/compensation, I would be prepared to offer non-discriminatory reasons as to why they exist. Especially if one were to feel they were gender-related, with the Lilly Ledbetter Act, the employer has much more liability.

And I just read an article that the Labor Secretary is pushing for MORE openness in salaries/compensation/wages rather than less.
