What are the rules in California about to whom we should be issuing the final paycheck (including accrued vacation) to for a deceased employee. Should it just be issued in the name of the employee and

What are the rules in California about to whom we should be issuing the final paycheck (including accrued vacation) to for a deceased employee. Should it just be issued in the name of the employee and let the heirs/executors/probate try to unscramble it, or are there situations where we are obiligated to issue in other names? There seems to be a rule for surviving spouses in CA, but how about other potential beneficiaries??

I strongly suggest posting your question or searching for an answer at www (dot) payrolltalk(dot) com. That is a board much like this that deals mostly with payroll issues. And there are a couple of very good gurus over there.

My sympathies for your loss, I always recommend that organizations have written policies/instructions that include this kind of situation. It can be very difficult, especially when you know the family is depending on you.
