Comp Time

Thanks everyone for your input.

Any suggestions on how we can resolve the issue of who has outstanding comp time/how much etc? We want to be as fair as possible to all, but I am not sure the best way to do it.

How many other exempt employees do you have (other than the 4 in this specific dept)?

Personally I am not coming up with any thing that is fair to all especially since you know one employee worked no extra hours.

If you are in NY, here is what i found on fringe benefits: "An employer is guilty of a misdemeanor if he or she fails to provide employees the benefits and wage supplements that were agreed upon. Wage supplements include vacation or holiday pay, paid sick leave, reimbursement of expenses and other similar items. Every employer is required to notify employees in writing or by publicly posting the employer's policy on sick leave, vacation, personal leave, holidays, and hours of work.

The Department of Labor has the authority to administer the law requiring payment of agreed fringe benefits." http://www.labor.state.ny.us/workerprotection/laborstandards/workprot/fringben.shtm

You could argue (1) it wasn't an employer policy because it wasn't posted but I don't know how far you would get. Or (2) that it was "agree upon" and therefor owed.

I would suggest contacting the NY DOL and asking them. See if you can get any type of answer in writing.
