We pay for 7 holidays for fulltime employees but have found that shutting down the business for all of those days has had an adverse effect because it shuts us down essentially for the more than just the holidays. We would like to shut down for just 3 major holidays. Management proposed giving employees 4 extra days of vacation. However, since we have to pay out vacation upon termination, I wanted to find a different solution. I know that ,at least in California, to make these days floating holidays will essential put them in the same category as vacation unless they are conditioned acceptably. My suggestion is to require that the holidays be used within the same month or even a two week period around the holiday, possibly allowing one employee to be off each day of the weeks surrounding the holidays so that we could stay open the entire week but would be short staffed by only one person each day.
Any suggestions?

What type of business are you in? I think this would be a tough sell since so many people, short of retail, don't work on the Memorial Day, 4th of July or Labor Day.

We are in the service business and service customers in-home. Many customers like us to come on the holiday so they don't have to take another day off. We schedule appointments through the call center which is shut down as well so without taking calls on the holiday, we lose business for the following day as well. We try to book technicians as far in advance as possible, but since some calls are booked for the next day, we are losing too much business.
We have several employees who don't really care about taking the holidays on the actual day of the holiday and will allow some to have the holiday off.
We would even be willing to allow employees off during the month of the holiday so avail themselves of a three day weekend, but just need to make sure that this is enough of a condition to satisfy the DLSE.
I was wondering if anyone had any input or experience regarding this situation-possibly operations that run 6-7 days a week such as retail businesses.
