We have a TPA doing our COBRA so I am sure that is why it is done as it is. We are the middle link in the process. Sometimes I wish the carrier would do it.
I agree if the carrier is administering it, then they would have both premium billing and claims data to be able to do what the OP is asking. And possibly might do so. Where they are changing the status after the payment due date but before the payment date (i.e. during the grace period) I also agree it is going to depend on the SPD and contract between the employer and the carrier. I don't know of any laws that would prevent this...However, for example, Texas does have a state law that requires group plans to cover the employee through the end of the month and to inform the insurance company by a certain date that an employee is terminated, otherwise the employER is charged the premium which is often unrecoverable from the ex-employee. And therefore claims would be paid during that month for that employee. |
