How do you check references for candidates whose previous managers are prohibited from speaking about their performance (company policy)?

I don't allow managers to provide references either, so I'm one of those problem companies you may encounter. The laws in our state only allow verification of rate, position, and dates of service. Anything beyond that requires authorization in writing from the employee. The odds are pretty slim that a manager, except the HR manager, would know if that authorization was received. Plus, you can't control what's being said. That floor manager may be working from hearsay or from one of those mysterious files that appear only in the managers' desk, and not in the personnel jacket.
Anyway, for those situations where you are not able to get a reference, take a look at the labor-laws in your state for the employees' rights to their personnel folder. Many states allow the employee to request copies of all, or part, of their file. Ask the candidate to furnish a copy of their last 2 performance evaluations.
