I have an employee in MI (we are in CA) starting but I will not be able to certify her I-9 form. Who can do this since there are no offices out there. Also, I know a notary cannot do it since we are n

I had legal counsel research this and the dilemma is that SOME members of the NNA hold that they cannot notarize documents like the I-9, however, this is not a stated (as in writing) standard of the NNA. Additionally, NO STATE prohibits notaries from doing this.

As some would conclude, I trust this information is helpful.

Hey HR PRO,
Have you relied on Notaries to do this? If so have you had any push back from them or in general has it been easy to get the I-9 done by them?

We have not yet used notaries; yet. I have a substantial number of isolated homebased employees all over the US and we were exploring this as an alternative. many of these employees are in excess of 100 miles from our nearest facility. One of our Corporate notaries shared with me that Notaries were prohibited from doing this. So i tasked my Corporate Counsel with researching it. Their answer is as above.

As to notary I-9 debate, keep in mind that the form I-9 does not require an actual notarization. If a "notary" was utilized, they would not be functioning as a notary, but as a deputized company representative.

gwald is correct. Notaries are not acting in their Notary capacity when they complete the form. But some notaries and the NNA has said that NOTARIES should not complete the form. It's up to the individual person whether they'll complete the form or not. If they complete it they're not acting in their notary status.

We have employees all over the US and have yet to have one employee tell me that a notary refused.

This is a very old thread.

I fall into this trap frequently when we have a new member that sees a topic to which they want to reply.
