I sent an applicant for a drug screening a week ago and it came back positive. We can no longer offer this person a position with us and he/she doesn't know this yet. Do I tell this person why we can

Where's the sarcastic dismissive tone from the HR rep?

The applicant tested positive on the drug screen. We contacted the applicant to let him/her know and to offer other alternatives if he or she feels the screening was inaccurate. No sarcasm, nothing dismissive.

If my tone was dismissive or sarcastic on this forum, I can assure that is not the case with any of our applicants.

The science is solid. If this person tested positive and the MRO called this person and confirmed that there is no legitimate medical reason for this person to test positive, in and of itself, the MRO's word is conclusive. There could be a chain of custody issue where the specimens were confused with another. I doubt it. Your prospective employee is most likely a user.

With regard to telling the employee about the test results, the MRO told them when he or she confirmed that the "drug" had no legitimate medical reason for showing up in their system.

This scenario comes up very often in my job. Applicants call and ask about the results of their drug screening - some of them act surprised at the positive results and some are very angry because they swear that they aren't using drugs. Either way, the applicants appreciate an explanation of what occured. I usually am very empathetic and refer them to the MRO to obtain answers to their questions. I think that it is just common courtesy (and in some cases required by law) to give them this information.

This has never been an issue in our pre-employment testing. Our MRO is instructed to administer the drug test first, and if the applicant fails the test, the testing is immediately stopped and the applicant is informed as to why it was stopped. We, as the employer, are not provided with info from the MRO other than a "pass" or "fail" unless we request that the sample be sent to the lab for further investigation. It is very rare that we do this, as the MRO asks for all medications (even OTC's) that the applicant is on. Basically, we know that when a test is stopped and there is no argument from the applicant, then they tested positive for an illegal substance.

I usually state our decision when I send the adverse action letter.
