I have sort of been thrust into the HR area of our small office and have a question about I-9 Forms. I have always thought that you have to get a completed I-9 form for every employee. We have one employee that when asked to complete the I-9 refused to do so. So I need to know if I need to persue this further and get the principal involved in trying to secure the I-9 from this employee.

Thank you both. That was my feling on it but Owner doesn't seem to see the importance of having the required paperwork on all employees. Since he won't listen to me (I am not an HR pro) maybe this will thread will compel him to get the paperwork from this individual. Part of the problem is this individual is a long time friend of the owner and he doesn't want to push her to fall in line with what's legal.

Let him know he can go to jail for not complying. That might get his attention.

Just to clarify, the original post could be interpreted that this is possibly a current, long time employee? If so, and depending on original date of hire, an I9 may not be necessary. When the I9 was first put into play you did NOT have to go backwards and get them completed on existing employees - only new employees going forward. This is still true today. Also, remember to start using the new version on February 2, 2009.
