At my business, we recruit people to attend focus groups (they are paid to attend these). In order to do this, we review a list of qualifying questions to see if someone qualifies.

I recently discovered we were asking a question that reads "Do you have any physical difficulties that would prevent you from reading or writing?" We obviously don't want a blind person coming to a focus group where a video presentation is the focus. Being HR manager, I feel a responsibility to at least check this out - is this question a problem for us, since we are asking about physical difficulties? We are qualifying someone for a particular activity, in which they'll be paid.

Also, I'm told we are automatically disqualifying anyone over 70. In the past we've had difficulties with older individuals getting to the facility and some then have physical difficulties that prevent them from participating. Any advice?

This may be no big deal at all - I'm just new and want to make sure I'm checking it out. Thanks.

I would recommend you consult with a attorney familiar with the American's With Disabilities Act (it covers more than just employment), the Age Discrimination In Employment Act, and your state's civil rights statutes. You are wise to be asking these questions. I, too, would be interested in investigating the legality of these practices.
