Do companies need to have a specific program in place following certain guidelines in order to claim they offer equal employment opportunities? I am writing our employee manual and my manager thought she had heard we must a have specific program in place before we can claim EEO.

Well, in my view, honesty is always the best policy. There is no federal or state requirement of which I am aware which prohobits a company from saying that they comply with EEO laws or the like. There ARE federal and state requirements which require you to do so. That is, an employer may elect to advertise itself as a company which does not discriminate on the basis of race, creed, color, religion, national origin, age, sex, status as a veteran or any other protected characteristic. There is also no specific program that an employer must comply with in order to make the statement. (In other words, to make the statement if it is not true would not be illegal). Of course, the law prohibits an employer from discriminating on the basis of race, creed, color, religion, national origin, age, sex, status as a veteran or any other protected characteristic. (In other words, to do the DEED is illegal, whether you claim you did not do it or not.)
