I work in a non-profit agency which does not have to comply with Executive Order 11246 (affirmative action). However, I believe I need to create a procedure for filling vacancies. We have not been consistent in posting internally and also Managers are seeking their own applicants to fill vacancies. Is there any law that I
am out of compliance on or is it just a bad business practice? (p.s. I think I know the answer to this but I need back-up).

You'll never know...up to this point...unless someone presents you with a complaint. Not having those procedures is "B.B.P.", but non-compliance is in the eyes of the complainant, especially if you're not really sure of how those inconsistant choices were made, and on what basis the decisions were based. There may not be a mandate to have procedures, but they certainly make defending your decisions a lot easier.

I agree with Jim. How do you prove why you picked on candidate over another? How do you defend against "adverse impact" discrimination claims? How do you establish the fairness of your procedures if there are no procedures? The choice, however, belongs to you.
