I need an explanation of a "leased employee" and an overview of how they are different from my current employees. Can you take current employees and make them "leased" if your Co. forms another Corp.

I need an explanation of a "leased employee" and an overview of how they are different from my current employees.
Can you take current employees and make them "leased" if your Co. forms another Corp.?

An over-simplified test would be "who is responsible for their withholding"; if a w-2, comes from you, they're yours; if you issue a 1099, they are contracted labor; if neither, they're leased, or contingent workers.

Sorry, Jim, I think you missed this one.
The whole "leased" employee, vs. "joint employee," vs. "your employee" think is all over the map. It is not an easy issue. There are numerous different findings depending on the statutory claim involved. If you think you have leased employees, you would be well served by consulting with legal counsel about this complex and potentially expensive issue.
