I am about to do training with a group of lead workers who are in a wide geographical area and not supervised closely. Do the new sexual harassment guidelines about supervisory responsibility apply to them or do we know yet?

Train them; regardless of the actual definition, it can't hurt.

Include any employee, regardless of title, who can: hire, fire, promote, discipline, review, train, assess, or can effectively recommend any of the above, or whose input or opinion on the above would be given consideration by management.

If your lead-people are in a position to affect any employee's (or potential employee's) employment terms or conditions in any way, include them.

While a lead worker may not be a supervisor for NLRA purposes, and while there may be different standards for finding sexual harassment regarding supervisors and fellow workers, relying on these distinctions to decide to not train the lead workers about sexual harassment policies is risky at best, particularly where they are geographically dispersed and not supervised closely. Jurors tend to be less concerned with legal labels than what they believe was the actual relationship between an alleged harasser and victim.
