No, neither employee has started their FMLA leave. The company does want to honor it's paid leave commitment to the employee in the acquiring company. The company does not want to pay the employee in the acquired company because that has not been the policy in the past and noone has made a commitment to pay her for FMLA. They are concerned about setting a precedence for the merged company.
If they honor their commitment to pay the lady in the acquiring company, whose policy has been to pay for employees on FMLA, does this result in them having to pay for the FMLA leave for the lady in the acquired company?
