There has been much discussion lately about how to best handle payment of compensation time for exempt associates.
The articles and research I have done to date indicates that this is still a very gray area. Before I set about completely restructuring our compensation time program for exempt associates, I'd like to get a little more information. My understanding is that, although there have been a number of cases in this area, there has not been, to date, a precendent finding against an employer where compensation time payment to exempt associates has been found to violate the salary basis test. How real of a legal risk is paying compensation time to exempt associates? Also, what is the DOL's most recent stand on this issue? Any changes of late?

I'd like to put this question out to all of you to find out more about this topic. I'm also wondering what alternatives might exist in measuring and valuing exempt associate time in relationship to this type of program.

Your ideas and feedback are greatly appreciated.

I need to revamp the exempt comp time system where I work and could benefit from any accumulated research. I'm not sure where to look though.

Acording to DOL minimum guarentee plus extras ~541.118(B). It should be noted that the salary may consist of a predetermined amt constituting all or part of the employees compensation. In other words additional compensation besides the salary in not inconsistent with the salary basis of payment. This comes from Regulations Part 541: Defining the Terms Executive,Administrative, Proffessional and Outside Sales. A publication you can obtain from the DOL. No grey areas here, and it gives several examples. The Dol doesnt care if you pay exempt employees more as long as you dont touch the guarenteed salary. Non-exempt is a different story.

What about a new exempt employee who has not yet earned leave time but is forced to miss time due to personal and family illness? Does offering them leave without pay make them appear non-exempt?
