Last year, due to some changes, I was given the position of payroll coordinator. The coordinators of our various departments are the lead people on their team and supervise anywhere from 2 to 4 people. After I accepted the position, I found out that I was making $14,000 less per yr than the other two coordinators. (Both males.) I had been promoted from my previous position of payroll user specialist. I also found out that as the new payroll coordinator, I was making $3,000 less than the male who was working in the user specialist position in finance. I went to the director and pointed this out on various occassions, but he told me that I had to wait because the board would be handling this situation by May of 1999. Well, May has come and went and there were no resolutions. Actually, what happened, was in February of 1999, I was diagnosed with a chronic liver condition and am now very close to finding out the results of my Long Term Disability claim. This claim will be based upon my earnings when I became ill. Once I became ill I resigned the coordinator position, and was put in the user specialist position that I had oringinally occupied. I took a cut in pay, and my doctor has advised me to cut back my hours. I work between 30 and 32 hours per week. Do I have any legal recourse based upon this situation. If I do, where do I go for help. Thank you in advance for your attention to this matter.

Employers can generally control what they pay and to whom, however, the reason for any discrepancy can't be a discriminatory one; ie. basing the decision for a different rate on age, sex, national origin, etc.

If you feel you've been treated differently based on gender (I'm assuming that's where this is going, because you provided the gender of the others), the EEOC would be the place to take your complaint.

I completely agree with Jim's response.
