What legal rights do we have when being told an associate who is in too much pain to do light duty (following W/C accident), leaves work and assists another individual in changing a motor in his pickup truck? If we can prove this happened, can we terminate the associate? What if he is only "working on" the motor and didn't actually move it?

Light-duty restrictions apply around the clock; if you have an employee with physical restrictions, he/she must comply with them even when not at work.

You are safest, to avoid retaliation claims, by furnishing your carrier with the information you have, and your suspicions, and let them investigate it.

I agree with Jim. Bring this information to the attention of the carrier. If you really have a strong case, workers compensation fraud is a crime in most states. Some states have workers compensation fraud units and others let the district attorney's office handle the matter. You can always refer the matter to them.
