I recommend that my clients NEVER, EVER tell employees or write down that employees have a probationary period. The mere existence of a "probationary period" implies that after the probationary period ends, an employer can only be discharged for "cause" or "good cause." Of course, all of my clients have the right to fire an employee for a good reason, a bad reason or no reason at all, so long as it is not an illegal reason. In order to make sure that a recent hire does not get all the benefits on day one (you do want a waiting period), I build those waiting periods into the specific policies or benefits that I am providing. Thus, employees shall be eligible for vacation accrued at a rate of 1 day for each month of completed service following the first 60 days of employment. And so on.
This should all be spelled out in an employment handbook, for which each employee signs an acknowledgement of receipt.
