Recently our employees have brought to our attention they are routinly working 50 to 60 hour weeks without compensation. We have just asked for an on-call rotation, and above was thier response, they now want to be compensated in overtime and want to be paid on-call. No argument on hours worked. Is there a system were exempt employees can be riembursed wo threatening salary basis?

There are ways to pay over the salary amount - it's "under" that poses the major problem - however, no matter how you get creative, avoid paying the additional money based on hours worked or hours on-call.

Can you give me an example of a system that might work, or the terminology to use? Thanks

Unfortunately, no..not for lack of willingness, but I need to plead ignorance. The dangers inherent in salary and salaried overtime are hidden within the wage & hour regs of your state, and I'm by no means an expert, even in the ones from my state that I'm supposed to decipher on a daily basis. Ask your company's attorney to help craft a system for you - since he/she will understand the issues of your state that need to be avoided.
