I am confused about how discrimination laws would apply to a church setting. Is there any difference...can a church "get away" with more? For example, a friend of mine claims that the pastor of the church where she applied for a job asked some questions (re: age and nationality) that most employers would know not to ask. She was not offended (just surprised) and got the job but I was concerned about the "legality" (or prudence) of the pastor even unknowingly asking such questions.

Title VII provides an exemption for a "religious corporation" with respect to certain employment decisions under certain conditions. See 42 U.S.C. 2000e-2. The statute does not give religious corporations license to violate Title VII, but rather carves out a limited exception on the basis of religion. For an interesting discussion of the interplay of Title VII, the ADEA and the Religon Clauses of the First Amendment in a particular factual context, take a look at Scharon v. St. Luke's Episcopal Presbyterian Hospital, 929 F.2d 360 (8th Cir. 1991).
