I understand that the bill has passed and we will be returning to the 8 hr. overtime law on 1/1/2000. Instead of reading the entire bill, can you give me a sypnopsis of its contents? Are there any special provisions? Will the new bill revert to the overtime laws of 98? meaning, doubletime, 7 day workweek etc. Thank you in advance. |

It's understandable, according to my HR association's legal advisor, the bill went through 7 revisions before the final draft.
Check out two websites: www.employersgroup.com look under news or AB60 and the SHRM website shrm.org Basically: Time and 1/2 after 8 hours in a day Double time after 12 hours in 1 day Special premium for 7th day worked in legal workweek Maintains 1.5 hours OT after 40 hours worked Employees can make-up time for minor personal obligations without paying OT in an 8 hour day; make-up time has to be completed within same week; # of hours not to exceed 11 in 1 day to be exempted from OT Increases dollar threshold for Exempt - up to $23,920 Alternative workweek can be maintained by individual upon request in writing and so on! Thank Governor Davis for this one! |

Actually, California has been an anomaly in this regard for years by requiring OT for over 8 hours worked in a day. About three years ago, then
Gov. Pete Wilson changed it to what the other 49 states require for an OT threshold (over 40 in a week). Now it appears that Gov Davis is returning California to the OT over 40 and, with it, a return to a more pro-worker posture. |
