Can an employer (in California) "force" employees to take a vacation? Here is the situation: The company is about to be sold. The intent is to terminate all employees one day and the new owners will re-hire the employees the next day. Upon termination, all vacation pay must be paid out. The employer does not want to pay out the vacation, rather in the next 2 months, he wants the employees to take their vacations. Can he do this?

I can't give you the specifics of California law, but some general issues come to mind. Do you have a specific vacation policy, and, if so, what is it? Is there an applicable collective bargaining agreement or are there employment agreements? Will your layoff be large enough to constitute a mass layoff or plant closing under WARN? Do you have employees already out on protected (e.g. FMLA) leave? There are lots of issues here for your labor attorneys to help you with.
