How do I keep my correspondence with the company attorney non discoverable, where I don't have to share with the plaintiff's attorney? Is there a majic phrase that I as the HR Mgr. can use to protect the company's work product?
I want to do the right thing and not shoot myself in the foot by creating a paper trail vs a telephone conversation. thx in advance for the advice. |

If you are a manager of a company of a siginificant level (a policy level), you can assume that your confidential communications with your company's attorney are privileged. Of course, it is the company's privilege to waive (if it wants to do so), not yours. So, anything you communicate to counsel could be disclosed under certain circumstances. You should consult with your corporation's attorney to find out what its policy is on these matters. For my money, I lable all correspondence between a client and an attorney "Confidential and Privileged Attorney-Client Communication" just to be on the safe side. |
