One of our departments has made arrangements on their own to have an intern this fall. The intern would be paid a stipend for the internship (most internships in this field are unpaid).

How should this work without getting us in trouble with Dept. of Labor? Our dept. in question wants to pay $50/week stipend for each 20 hour week the intern works. Does this imply that the intern should be an hourly employee (and then subject to minimum wage and FLSA)?

I thought the stipend would be either a one time payment at the end of internship or half of payment halfway through and remaining half at end and that the payment would just go through accounting and intern would get a 1099. Now I'm not sure.
