Each year my children fill out an emergency card for school. This card includes: Contact, Some medical History, permission for Emergency medical treatment. My question is, "Is it legal to request and maintain a similar file of information on employees?" The main reason, we recently had an employee fall very ill at work. We called an ambulance, but no one knew her medical history, nor whom to contact, and the employee was not able to answer this information herself.
(2)I would like to implement an identification system for our personnel files. All we are currently interested in is taking an employee's photograph for their file. These photos will not be circulated nor available for publication without prior written permission.

We currently have a form that employees fill out that has emergency medical contact information on it. The form is maintained in the medical file with limited access to it. As for the photo, we have ID badges that our employees use and the photo is scanned into our HRIS. That is all we keep for photos.

We have the same system. A basic employee information form (who to notify in case of emergency), and ID cards with pictures scanned in the computer system.

Remember that all medical information kept by the employer must be kept pursuant to the Americans with Disabilities Act. I have not probable keeping emergency contact information in the personnel file. Medical "history" information and information about "treatments" must be kept in a separate file to which access is strictly "as needed." The hard part here is what do you do if the employee refuses to give you this information?
With respect to photographs, I have no real problem with keeping employee photographs in the file. An employer should not use them without the employee's permission.
