Question: What are the legal requirements for job descriptions? I'm redoing very old job descriptions and want to make sure that the finished product is legally compliant.

I've done numerous job descriptions and follow a format by HRN Management Group of Salt Lake City, UT. They are always current on the ADA requirements and the job description is broken down into several parts such as Essential Functions, Performance Measurements, Qualifications, Intent & Functions of Job Descriptions, Physical Activities & Requirements of the Position, Mental Activities & Requirements of the Position, and Working Conditions.

The only "legal requirements" I know of relate to ADA. Under ADA, you need to be able to document the essential functions of the position. Well written job descriptions help meet that requirement. As usual, there may be state requirements in some states.

Technically, and generally, there are no "requirements" for inclusion in a job description because there is no requirement to have a job description. I agree that it is a very good practice under the ADA to list the essential functions of the position, but that is a "practice" not a "requirement." (Picky, picky, picky -- but that's my JOB!)
