Using a PC does not grant exempt status - it's what the person does with it that gives exempt status.

As hrbt said, most admin assistants are non-exempt. Only executive admins to a very high level official/executive can be exempted.

The Fair Labor Standards Act covers the questions you have in detail. It sounds as if your employer is in violation of FLSA guidelines. You can file a complaint with your State or Federal Dept. of Labor to start an investigation.

jeanneb is an HR person with a good understanding of the FLSA. She was not asking about how to file a claim (heaven forbid that an HR person would do something like that!) but rather how to explain to her company's management staff that they are violating the FLSA.
