Due to a broken water main our office (in California) currently does not have functioning restrooms; there is no ETA on when this will be repaired. Neither I nor my colleague can find anything about the legality of having employees work in an environment with no restrooms, and the closest one is a short drive away - not walking distance.
Anyone have any info feedback on how to proceed? Should we allow employees the option to go home without pay? Thanks!

I think the local building code requires restroom facilities to get a certificate of occupancy. I believe that certificate can be revoked upon inspection by the city or county building inspector.

I agree that I would call the city/county inspectors and ask what the code is.
Is the broken main something that it is your company's responsibility to fix or the city/county's? It might be that there is nothing your employer can do to fix it (or to get it done quickly).

Marc is correct. We were left without water due to a school deconstruction/construction project and were advised we would have to provide portable restroom facilities or close. We chose to close that one facility until the water connection was restored.

anneha offers the best solutions regardless of local building codes. Thesse are your employees and providing for their needs while they provide labor to you is a part of the "contract" of the workplace. Harping over paid or unpaid time for restroom breaks when facilities are not immediately available, absent abuse of course, will not show you or your employer as a very good place to work. Either get the portable replacements or shut down until repaired makes sense.
