Texas does not require that employers provide vacation. Further, there is no requirement that employers in Texas pay out for unused PTO/vacation upon termination.

Just one note...while the state doesn't require either accrual or payout, they will enforce your company policy. So if you policy states you will pay it out, then the state of Texas will require you to do so under a wage claim.
